Terms of Service
These Terms of Service ("Terms") govern your use of bambam.surf and the BAMBAM surf alert service (the "Service") operated by Maestro Technologies LLC. By using the Service you agree to these Terms.
1. The Service
BAMBAM provides surf forecasting and personalized alerts based on publicly available weather, wave, and tide data combined with our own modeling. Alerts are delivered via WhatsApp, SMS, Telegram, and other channels we may add.
2. Forecasts are predictions, not guarantees
Surf forecasts are inherently uncertain. BAMBAM provides forecasts on an "as is" basis with no warranty that conditions at any break will match predictions. You assume all risk associated with deciding whether and when to enter the water. Always check current conditions, know your limits, and surf with appropriate caution.
3. Subscribing and unsubscribing
You can subscribe to alerts free of charge. You can unsubscribe at any time using the methods in our Messaging Terms.
4. Acceptable use and respect policy
BAMBAM is a service for the surf community. We expect every user to engage respectfully. Give respect to get respect. You agree not to:
- Use the Service for any unlawful purpose.
- Attempt to gain unauthorized access to our systems or interfere with the Service.
- Resell or commercially exploit BAMBAM forecasts or alerts without written permission.
- Harass, abuse, threaten, or use hateful or discriminatory language toward BAMBAM staff or other users.
- Spam, scrape, or attempt to reverse-engineer the Service.
- Misrepresent your identity, location, or affiliation.
We reserve the right to refuse service, suspend a subscription, or terminate an account at any time and at our sole discretion in response to violations of this section or for any reason consistent with our policies. Decisions about suspension and termination are final.
5. Intellectual property
The Service, including the BAMBAM name, logo, forecasting models, and content, is owned by Maestro Technologies LLC and its affiliates. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose.
6. Third-party services
The Service relies on third parties (Twilio, WhatsApp/Meta, Telegram, Cloudflare, and others) for delivery and infrastructure. We are not responsible for outages of those services. Their respective terms apply when you receive messages through their platforms.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF FORECASTS.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAESTRO TECHNOLOGIES LLC, ITS AFFILIATES, AND THEIR OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
9. Indemnification
You agree to indemnify and hold harmless Maestro Technologies LLC and its affiliates from any claims, damages, or expenses arising from your misuse of the Service or violation of these Terms.
10. Termination
We may suspend or terminate access at any time for any reason, including violation of these Terms. You may stop using the Service at any time.
11. Governing law
These Terms are governed by the laws of the State of Georgia, United States. Any dispute will be resolved in the state or federal courts located in Georgia, and you consent to their jurisdiction.
12. Changes
We may update these Terms. The "Last updated" date will change and material changes will be communicated through the Service.
